Welcome to NerdFlipz. By accessing our website, placing an order, requesting a design, or using our services, you agree to be bound by the following Terms of Service. Please read them carefully.

1. About NerdFlipz

NerdFlipz is a creative design and apparel brand specializing in custom apparel, digital artwork, graphic design services, and original merchandise.

These Terms govern all purchases, custom orders, design services, and interactions with NerdFlipz.

2. Acceptance of Terms

By accessing our website, submitting an inquiry, requesting a quote, approving artwork, or purchasing products or services from NerdFlipz, you acknowledge that you have read, understood, and agree to these Terms of Service.

If you do not agree to these Terms, please do not use our services.

3. Products & Services

NerdFlipz offers products and services including, but not limited to:

  • Custom T-Shirts
  • Custom Hoodies
  • Event Apparel
  • Church Apparel
  • Family Reunion Apparel
  • Business Merchandise
  • Graphic Design Services
  • Digital Artwork
  • Logo Design
  • Original NerdFlipz Merchandise
  • Other custom creative services

All products and services are subject to availability.

4. Custom Design Orders

Custom orders require clear communication regarding design expectations, sizes, colors, quantities, and deadlines.

Customers are responsible for providing accurate information during the ordering process.

NerdFlipz will make reasonable efforts to produce designs that closely match approved proofs. Minor variations in color, placement, sizing, or print appearance may occur due to differences in screens, printing methods, materials, and manufacturing processes.

Such variations shall not be considered defects.

5. Design Proof Approval

When applicable, customers will receive a design proof for review before production.

By approving a proof, the customer confirms that all details are correct, including but not limited to:

  • Names
  • Dates
  • Spelling
  • Grammar
  • Colors
  • Design placement
  • Sizing
  • Quantities

Once a proof is approved, NerdFlipz is not responsible for errors that were present in the approved design.

Additional revisions requested after approval may incur additional fees.

6. Customer-Provided Content

Customers may submit logos, artwork, photographs, text, or other materials for use in custom projects.

By submitting content, the customer represents and warrants that:

  • They own the content, or
  • They have obtained all necessary permissions and licenses to use the content.

NerdFlipz assumes no responsibility for copyright infringement, trademark infringement, or intellectual property violations resulting from customer-provided materials.

Customers agree to indemnify and hold NerdFlipz harmless from any claims arising from submitted content.

7. Intellectual Property

All original artwork, graphics, designs, website content, branding, logos, product concepts, and creative materials created by NerdFlipz remain the intellectual property of NerdFlipz unless otherwise agreed in writing.

Purchase of a product does not transfer ownership of the underlying artwork.

Customers may not reproduce, resell, modify, distribute, or commercially exploit NerdFlipz designs without written permission.

8. Custom Design Ownership

Unless otherwise agreed in writing:

  • NerdFlipz retains ownership of all design concepts, drafts, sketches, and unused artwork.
  • Final custom designs may be used by the customer only for the intended purpose agreed upon during purchase.
  • Exclusive rights, commercial licensing, or full ownership transfers must be negotiated separately.

9. Payments

Payment must be received before production begins unless otherwise agreed.

For larger projects, NerdFlipz may require:

  • A non-refundable deposit
  • Partial payment upfront
  • Full payment before delivery

Failure to complete payment may result in cancellation of the project.

10. Cancellations

Orders may be canceled before design work or production begins.

Once design work has started, NerdFlipz reserves the right to retain payment for time spent creating concepts, revisions, and artwork.

Orders may not be canceled once production has begun.

11. Refunds & Returns

Refunds and returns are governed by the NerdFlipz Refund & Return Policy.

Custom products, personalized items, digital artwork, and design services are generally non-refundable unless an error was made by NerdFlipz.

12. Production & Shipping

Production and delivery estimates are provided as a courtesy and are not guaranteed.

NerdFlipz is not responsible for delays caused by:

  • Shipping carriers
  • Weather conditions
  • Supply shortages
  • Production interruptions
  • Events beyond our reasonable control

Risk of loss transfers to the customer upon delivery to the shipping carrier.

13. Digital Products

Digital artwork, design files, downloadable products, and other digital goods are non-refundable once delivered.

Customers are responsible for maintaining backup copies of digital files after delivery.

14. Right to Refuse Service

NerdFlipz reserves the right to refuse or cancel any order, project, or service request for any lawful reason, including but not limited to:

  • Intellectual property concerns
  • Offensive or unlawful content
  • Harassment or abusive behavior
  • Fraudulent activity
  • Requests that conflict with the mission, values, or creative standards of NerdFlipz

15. Limitation of Liability

To the fullest extent permitted by law, NerdFlipz shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from:

  • Use of our website
  • Purchase of products
  • Design services
  • Shipping delays
  • Loss of profits
  • Loss of business opportunities

NerdFlipz's total liability shall not exceed the amount paid by the customer for the applicable order.

16. Website Use

Users agree not to:

  • Use the website for unlawful purposes
  • Attempt unauthorized access to website systems
  • Disrupt website functionality
  • Submit harmful code, malware, or malicious content

NerdFlipz reserves the right to restrict access to users who violate these provisions.

17. Privacy

Any personal information collected through our website will be handled according to our Privacy Policy.

By using our services, you consent to the collection and use of information necessary to process orders and provide customer support.

18. Changes to These Terms

NerdFlipz reserves the right to update or modify these Terms of Service at any time.
